Macarthur Coal Limited - Panel Declines to Conduct Proceedings

The Panel has declined to conduct proceedings on an application dated 7 April 2010 from Peabody Energy Corporation in relation to the affairs of Macarthur Coal Limited (see TP10/12).

Earlier today, the Panel declined to make an interim order postponing the shareholders' meeting scheduled to take place on 12 April 2010 (see TP10/13).

The Panel will publish its reasons for the decision in due course on its website.

The sitting Panel for the proceedings was Hamish Douglass (sitting President), Paula Dwyer and David Friedlander.
